A division bench of Chief Justice Abhay Oka and Justice S Vishwajith Shetty, while hearing a petition filed by All India Council of Trade Unions(AICTU) and High Court Legal  Services Committee, observed : “There can be no dispute that our Constitutional philosophy does not permit any form of manual scavenging. Right of a citizen to live with dignity is an integral part of the fundamental rights guaranteed to the citizens under Article 21 of the Constitution of India. The preamble of the Constitution shows that the Constitution seeks to protect the dignity of an individual. There can be no dispute that manual scavenging is most inhuman and it infringes the fundamental rights guaranteed under Article 21.” The bench held that “If any citizen is forced to do manual scavenging, it will be a gross violation of his fundamental right conferred under Article 21 of the Constitution of India. Under Article 47 of the Constitution of India which is a part of Directive Principles of the State Policy, the State is under an obligation to endeavor to improve the standard of living of its people.” The court also highlighted the major difference between the old act (Employment of Manual Scavengers and Construction of Dry Latrines (Prohibition) Act, 1993) and the Act of 2013. It said that the definition of ‘manual scavenger’ in the Manual Scavengers Act is much wider than the definition of ‘manual scavenger’ defined under clause (j) of Section 2 of the old Act. “Under sub-section (1) of Section 5 of the Manual Scavengers Act, there is a complete prohibition on manual scavenging. Under Section 3 of the old Act, the State Government was required to issue a notification for prohibiting engagement or employment of any person for manual scavenging”, the Court said. It added “Thus, under the old Act, the prohibition was not automatic. The provisions of the new Act are more comprehensive.” On going through past orders passed by the courts and compliance reports filed the bench said: “We have found that there is hardly any implementation of the provisions of the Manual Scavengers Act and the Rules in the State of Karnataka. Therefore, this is a case where continuous monitoring will be necessary and the power of issuing continuing mandamus will have to be exercised.” Accordingly, the bench issued the following directions: *The State Government shall place on record the details about the number of First Information Reports registered for the offences punishable under the Manual Scavengers Act, the details of the cases in which charge sheets were filed, the details of the cases which are pending and the details of the Cases which resulted in conviction. The figures of cases which resulted into acquittal shall be also placed on record. *The State Government shall place on record the compliance of the decisions taken in the meeting held on 23rd February 2018 under the Chairmanship of the then Additional Chief Secretary. *The State Government shall produce necessary material to show that the District Level Survey Committees as contemplated by sub-clause (c) of Rule 2 of the Manual Scavengers Rules have been duly constituted. The State Government shall also call for the data from all the Districts for ascertaining whether the District Level Survey Committees have conducted surveys of manual scavengers and whether the Committees have published the final list of Manual Scavengers of the respective Districts. *The State Government shall place on record the necessary details as regards the constitution of the State Level Survey Committees as well as the details regarding the number of meetings of the State Level Survey Committee has held and the gist of functions so far discharged by the State level Committee; *The State Government shall place on record comprehensive data about the survey of insanitary latrines throughout the State and the details about the conversion/demolition of insanitary latrines; *The State Government shall place on record the details relating to final publication of the District-wise final lists of Manual Scavengers and the publication of State level final list of Manual Scavengers *The State Government shall issue directions to all the Local Authorities to implement the provisions of the Manual Scavengers Act and the Rules by specifically referring to the obligations and duties under various provisions. The compliance by the Local Authorities shall be monitored regularly by the State Level Monitoring Committee. *The State Government shall direct all the Local Authorities to comply with the obligations under subsections (2) and (3) of Section 4 and to immediately ascertain the requirement of number of sanitary community latrines within their respective jurisdictions and thereafter, make construction of such latrines. The data of such community sanitary latrines constructed in the State shall be placed on record; *The State Government shall immediately initiate an awareness campaign on a large scale for elimination of the practice of open defecation and ensure that all Local Authorities comply with their obligation of eliminating the practice of open defecation in their jurisdiction. The State Government shall take help of NGOs and the Karnataka State Legal Services Authority to conduct the campaigns in rural areas; *The State Government shall place on record the steps taken for rehabilitation of manual scavengers as provided in Section 13 by stating whether there are any Schemes of Central and State Government for rehabilitation of the manual scavengers as contemplated by Section 13. *The Karnataka High Court Legal Services Committee and all the District Legal Services Authorities will be entitled to convene meetings of all the stakeholders for assisting them for making compliance with the directions issued by this Court and for implementation of the Manual Scavengers Act and the Rules framed thereunder. The court has directed the State Government to file compliance affidavits on or before 30th January 2021. first_imgWigan Athletic have announced the appointment of club captain Gary Caldwell as their new manager, just a day after the sacking of Malky Mackay.The struggling Latics axed Mackay as boss on Easter Monday, following a 2-0 defeat to Derby County which left them eight points adrift of safety in the Championship’s bottom three.Chairman David Sharpe, who only replaced his grandfather Dave Whelan in the role last month, insisted he made the change “for the long-term future of the club” and has moved quickly to install the controversial Scot’s successor, with central defender Caldwell penning a “permanent contract” as manager.The 32-year-old told the club’s official website: “We are in a really tough place at the moment, but we will approach the next five games with only one thing in mind, to win. first_imgPlanned for a site about 30 miles west of Philadelphia, Three Groves Ecovillage will add to the uptick in cohousing communities that have embraced energy efficiency and other green building goals.As currently designed, Three Groves will include solar thermal and photovoltaic systems with enough capacity to allow the community to operate at net zero energy. Its site management, construction, and materials strategies, meanwhile, are aimed at earning the project LEED for Homes Platinum certification.Cohousing has so far found its way to 38 states, according to the Cohousing Association of the United States, whose directory lists almost 250 cohousing projects in the U.S. Eight of those projects are in Pennsylvania. And though not all ecovillages adopt the characteristics of cohousing communities (such as a resident-directed site plan that clusters residences around a common house), many cohousing communities have embraced ecovillage concepts of environmental stewardship, which typically include energy-efficient housing and renewable-energy systems.Ecovillage and cohousing compatibility Abundance EcoVillage, a community of 14 homes on 15 acres in Fairfield, Iowa, for example, is not a cohousing development, although the homeowners there do share the cost of maintaining the community’s renewable-energy systems – two wind turbines (one with a capacity of 3 kW, the other with a 5 kW potential output), and a 7-kW photovoltaic array.Meanwhile, EcoVillage at Ithaca, in upstate New York, is a true cohousing community of 60 units whose planned third neighborhood, a 40-unit project, is expected to include about 25 homes built to the Passivhaus standard.Three Groves Ecovillage homes, nine of which have been sold so far, will range in size from 1,193 square feet for a one-bedroom home to 1,965 square feet for a four-bedroom home, with prices ranging from about $200,000 to the low $400,000s. first_imgVICTORIA, B.C. – The provincial government wants to make B.C. drivers pay ICBC premiums that more fairly reflect the risk they represent on the roads.ICBC‘s current rate structure is more than 30 years old. It is built around ensuring the vehicle rather than the driver and allows discounts to drivers despite multiple crashes.The structure has resulted in British Columbians with crash-free, clean driving records subsidizing bad drivers, including those with multiple accidents. B.C. Attorney General David Eby explained the submission ICBC is making to the BC Utilities Commission (BCUC) will include revenue-neutral proposals aimed at levelling that playing field. “We want to modernize ICBC so that British Columbians pay according to their crash history, driving records and level of risk, and take responsibility for their driving habits,” said Eby.  “It’s only fair.”“Right now, the system is broken. A driver with no crashes could be paying the same premium as a driver with three at-fault crashes in a year. We heard from British Columbians that their insurance rates need to be fair and we agree. Good drivers shouldn’t have to continue paying more to cover the costs for those who cause crashes or present a higher risk on our roads.”The proposed changes align with the feedback the government received from nearly 35,000 British Columbians on how to make insurance fair. Proposed changes to basic insurance include: Moving to a driver-based model, so that at-fault crashes are tied to the driver and not the person who owns the vehicle.Increasing insurance discounts for drivers with up to 40 years of driving experience, up from the current limit of nine years.New discounts available for vehicles with original, manufacturer-installed automatic emergency braking technology and for vehicles driven less than 5,000 kilometres per year.Basic insurance discounts for inexperienced drivers will be adjusted to better reflect their risk.At-fault crashes will have a larger impact on the premium a driver pays.Rate classes and territories data will be updated for the first time in more than 10 years to reflect significant changes in traffic density, population growth and changes in the urban infrastructure.An increase to the Driver Penalty Point (DPP) and Driver Risk Premium (DRP) programs of 20% in fall 2018 and 20% in fall 2019, as previously announced.“The changes we are proposing are the most significant updates to how ICBC‘s basic insurance premiums are set in more than 30 years,” said ICBC’s Board Chair Joy MacPhail. “When British Columbians were asked for their feedback on this topic, one message came out loud and clear, lower-risk drivers shouldn’t be paying the same as some high-risk drivers.”As part of these changes, ICBC is proposing a “transition cap” that limits how much the premium can change annually based on a customer’s driving record and at-fault crash history. Most customers will fully transition to their new basic premium within three years under the proposed changes.The B.C. government has directed ICBC to file an application with the BCUC by Aug. 15, 2018. Subject to approval, the changes would come into effect September 2019. Separately, the government has also directed ICBC to move the timing of its basic insurance rate application to the BCUC from late August to December to align any rate change with the other product changes already announced.last_img read more
